Calcutta High Court Questions EC Over ‘Power Misuse’

Kolkata, April 24, 2026 As election-related restrictions come under scrutiny, the Calcutta High Court has raised serious concerns over administrative decisions affecting public movement in West Bengal. The core issue centers on whether such measures are proportionate and justified, especially when they directly impact the daily lives of citizens during a sensitive electoral period. The court sharply criticized the Election Commission of India over its decision to restrict motorcycle movement ahead of polling. Justice Krishna Rao remarked, “You are misusing your power. Citizens are being harassed in this way.” The bench questioned the reasoning behind targeting motorcycles while allowing other forms of transport to operate without similar limitations. It further directed the Commission to provide clear evidence supporting its decision, including instances where motorcycles were linked to election-related violence. The court stressed that such blanket restrictions must be backed by solid data, as they can disrupt normal life and create unnecessary inconvenience for the public. The development highlights the judiciary’s role in ensuring accountability during elections. It reinforces that security measures must remain balanced, evidence-based, and respectful of citizens’ rights while maintaining order.
